§ 21-56. Duty of vehicle owner to name operator in violation; failure deemed prima facie evidence of owner as operator.

  • Upon receipt of the notice set forth in section 21-55 above, if the owner of the vehicle was not the operator of the vehicle at the time and place the violation occurred, such owner shall provide a sworn affidavit to the Okaloosa County Clerk's Office alleging another driver as the violator and must provide the full name, DOB, driver's license number and mailing address within the thirty (30) days set forth in section 21-55. Upon such owner's failing to do so he shall be conclusively presumed to be the operator of such vehicle at the time of the violation.

Ord. No. 12-07, § 5, adopted March 6, 2012, repealed the former § 21-56, and enacted a new § 21-56 as set out herein. The former § 21-56 pertained to similar subject matter and derived from Ord. No. 75-06, adopted March 20, 1975.
