§ 8-41. Imposition of assessments or utility fees.

(a)

The board hereby authorizes the imposition of stormwater utility fees or other assessments on all benefited property within the benefited area which shall be established or modified by ordinance as provided herein.

(b)

Prior to the imposition of the stormwater utility fees or other assessments, the board shall adopt a preliminary rate resolution which shall set forth the proposed stormwater utility fees or other assessments and establish the maximum rate for that stormwater utility fee or assessment. The preliminary rate resolution shall also schedule a public hearing for the adoption of a rate ordinance. Notice of the public hearing for the adoption of the rate resolution shall be in accordance with law.

(c)

The rate ordinance shall be adopted at a public hearing and shall establish the amount of the stormwater utility fees or other assessments to be charged. The amount of the stormwater utility fee or assessment may be increased provided it does not exceed the maximum rate as established within the preliminary rate resolution.
