§ 3-59. Aircraft rules.

  • (a)

    Aircraft operations; conformance with FAA rules and regulations. Applicable rules and regulations of the Federal Aviation Administration and Eglin Air Force Base, as now established and as the same may be hereafter supplemented and modified, are hereby adopted by reference and made a part hereof as fully as if the same, and each, and all of them were set forth herein.

    (b)

    Administrative regulations; closing air terminal. The board or its authorized representative shall have the authority to close the air terminal or any portion thereof to air operations whenever it considers such action necessary to avoid endangering persons or property. The board shall have the right to deny the use of the air terminal or any portion thereof to any specific aircraft, if in its opinion the use of the air terminal or any portion hereof by such aircraft might be likely to endanger persons or property or constitute a nuisance.

    (c)

    Additional regulations:

    (1)

    All airlines operating in and out of the county air terminal shall have readily available the maintenance personnel and basic equipment to remove any disabled aircraft from the runway, taxiway or apron in an expeditious manner not to exceed one hour.

    (2)

    Contractual agreements with servicing personnel are permitted for removal, towing, and related activities.

    (3)

    The following basic equipment shall be in place on the airport premises:

    a.

    A tow bar and a complete wheel assembly to include tire, tube, and rim for immediate installation on the nose gear and/or main gear.

    b.

    Jacking and towing equipment on the premises or available by contractual agreement.

    (4)

    All airlines are to provide to the airport manager a copy of all contractual agreements for servicing of aircraft, and to make available for inspection the basic equipment as required in subsection (3).

    (5)

    No aircraft shall be parked or stranded on the airport facilities except in areas designated for such use.

    (6)

    At the direction of the airport manager or other authorized representatives, the operator, owner or pilot of any illegally parked or disabled aircraft on the airport shall move the aircraft to a legally designated parking area on the airport. If the operator refuses to comply with the directions, the board, through the airport manager or authorized representative, may have the aircraft towed to such a place at the operator's expense and without liability for damage that may result from such towing.

    (7)

    In the event of an accident, the board, through the airport manager, may, in compliance with FAA and other governmental regulations, order the removal of damaged aircraft from the landing areas, ramps, aprons or other areas at the expense of the owner and without liability for damage resulting from such moving.

    (8)

    The pilot of an aircraft involved in an accident on or near the airport causing personal injury or property damage shall report to the airport manager. In the event that he is unable to do so, the owner of the aircraft or his agent shall make such report. Any person witnessing or having knowledge of an aircraft accident on the airport or within close proximity thereof, involving property damage, injury or fatality should notify the airport police by the most expeditious means.

    (9)

    Airport property, including the lighting fixtures, damaged or destroyed by an accident or otherwise shall be paid for by the parties responsible.

    (10)

    No person shall taxi an aircraft until he has ascertained by visual inspection of the area that there will be no danger of collision with any person or object in the immediate area.

    (11)

    Aircraft shall be taxied at a safe and reasonable speed with due respect for other aircraft, persons or property.
