§ 9-44. Prohibition of price gouging.

  • The sale or offer to sell any merchandise, services or other goods at a price in excess of the average retail price is prohibited during any local state of emergency. The average retail price as used herein, is defined to be that price at which similar merchandise was sold during the 90 days immediately preceding the local state of emergency, or at a mark-up which is a larger percentage over wholesale cost than was being added to wholesale cost prior to the local state of emergency.
