§ 6-1. Construction materials capable of causing sand discoloration or sedimentation of public waters.

  • (a)

    Prohibitions:

    (1)

    For the areas south of U.S. Highway 98 eastward from Brooks Bridge to the Walton County Line, including Okaloosa Island:

    a.

    Construction materials subject to wind or water transport that permanently discolor the sand are prohibited. Such materials include but are not limited to red or yellow clay or sand.

    b.

    Discoloring material used for horticulture may be used if planted immediately. Discoloration occurring must be limited to property planted. Such material extending to public or other property shall be a violation.

    (2)

    For areas within 200 yards north of Highway 98, material prohibited by subsection (a)(1) above may be used if contained by a concrete curb extending one foot below grade and covered by permanent surface within 96 hours.

    (b)

    Enforcement. Violations of this section shall be immediately reported to the county sheriff's department for enforcement.
