§ 21-73. Collection of fees.

  • (a)

    There is imposed a surcharge of $5.00 for each traffic penalty which shall be used to fund traffic education programs in schools located in Okaloosa County subject to the following provisions:

    (1)

    The clerk of the court shall collect an additional $5.00 with each civil traffic penalty.

    (2)

    Upon enactment of this ordinance, there shall be created a fund known as the Okaloosa County Traffic Education Fund.

    (3)

    This article provides for the board of county commissioners to administer the funds collected and shall be used for enhancement and not replacement of driver education program funds.

    (4)

    The funds shall be used for direct educational expenses and shall not be used for administration.

    (5)

    Each driver education program receiving funds shall require that a minimum of 30 percent of a student's time in the program be behind-the-wheel training.

    (6)

    All funds received by the clerk of the court pursuant to this article shall be deposited within ten days after the end of each calendar month, in the Okaloosa County Traffic Education Fund.

    (7)

    All funds raised by this article shall be budgeted and expended by the board of county commissioners by payment to the designated entity. The budgeting and expenditure of said funds is declared to be a proper public and county purpose in and for Okaloosa County, Florida.
