§ 19-1. Damage to or defacing county roads and rights-of-way.

  • (a)

    Permit required. No firm, corporation, business entity or other person shall in any way, face or form, operate, motivate or use any vehicle or instrument or construct any improvements on the public roads or rights-of-way in Okaloosa County, Florida, that has the capability to damage, deface or destroy the public roads or rights-of-way of the county without first obtaining a permit as provided in paragraph (b) below.

    (b)

    Cash bond required. Any firm, corporation, business entity or other person intending to operate, motivate or use any vehicle or instrument, as defined in paragraph (a) above, shall apply to the superintendent of roads [for a permit] and shall post a cash bond in double the amount of any anticipated damages as determined by the county superintendent of roads, and in the event the public roads or rights-of-way are not repaired or stored to their original state, such cash bond shall be forfeited.

    (c)

    Permit fee. The fee for the permit provided in paragraph (b) above shall be $10.00 for each site of potential damage.
