§ 16-3. Restricted areas on certain waterways—Idle speed/no wake.
(a)
Definitions.
(1)
Restricted areas are areas on waterways where the speed of vessels is limited to "Idle Speed/No Wake."
(2)
Vessel wake is the movement of waves created by the motion of the vessel. It is the track or path that the vessel leaves behind it.
(b)
Restricted areas. The following waterways within the county are hereby designated restricted areas:
(1)
All of that certain body of water known as Lake Lorraine, near the town of Shalimar, Florida, more accurately described in an exhibit on file with the county.
(2)
An area of Choctawhatchee Bay extending approximately 600 feet from the shoreline for a distance of approximately 1,500 feet along the shoreline adjacent to Gulf Islands National Seashore Park, less and except a one hundred-foot corridor through such areas, more accurately described in an exhibit on file with the county.
(3)
That portion of that certain body of water known as Indian Bayou in or near the City of Destin, Florida, highlighted and marked on an exhibit on file with the county.
(4)
All of that certain body of water known as Bal Harbor, near the Town of Shalimar, Florida, more accurately described in an exhibit on file with the county.
(5)
All of that certain body of water known as Swift Bayou, near Niceville, Florida, more accurately described in an exhibit on file with the county.
(6)
A portion within that certain body of water known as Cobb's Bayou, near Fort Walton Beach, Florida, more accurately described in an exhibit on file with the county.
(7)
A portion within that certain body of water known as Five Mile Bayou, near the Town of Cinco Bayou, Florida, more accurately described in an exhibit on file with the county.
(8)
A portion within that certain body of water known as west end of Cinco Bayou, near Pier 1 Condominium near Fort Walton Beach, Florida, more accurately described in an exhibit on file with the county.
(9)
A portion within that certain body of water known as Hands Cove, near Poquito Bayou in Shalimar, Florida, more accurately described in an exhibit on file with the county.
(10)
A portion within that certain body of water known as Grass Lake near Old Post Road, in Bluewater Bay, more accurately described in an exhibit on file with the county.
(11)
A portion within that certain body of water known as Snapper Cove in Cinco Bayou, more accurately described in an exhibit on file with the county.
(c)
Penalty. Violations of this section shall be prosecuted and punished as provided in Section 327.73, Florida Statutes (1992).
(d)
Regulatory markers. Regulatory markers shall be posted in accordance with the provisions of all local, federal, or state laws, rules, or regulations, applicable thereto.
