§ 15-146. Issuance or denial.

  • (a)

    Decision. The board shall consider the application at the next regular meeting following receipt of the recommendations, and if it finds that the proposed service meets the public convenience and necessity, issue a certificate, subject to such limitations as the board deems necessary to protect health, safety and welfare.

    (1)

    The certificate shall be valid for a period of two years. The certificate shall not be transferable or assignable, either voluntarily or by operation of law, without the prior written approval of the board.

    (2)

    Every certificate issued under this division shall state the service territory authorized, the minimum requirements for the motor vehicles to be used in the rendition of such service and such conditions and limitations as the board may deem necessary or proper in the public interest.

    (3)

    Duration and form: Certificates shall be effective only for two years from date of issuance and contain:

    a.

    The name of the service.

    b.

    A statement showing the classification of the certificate.

    c.

    The date of issuance and date of expiration.

    d.

    The geographic areas of, and any limitations on, operation and service in the county.

    e.

    The signatures of the chairman of the board and the clerk.

    (4)

    Reconsideration: The board may reconsider any application within 30 days after its denial, upon the filing of a petition alleging sufficient facts or errors to justify said reconsideration.

    (5)

    A certificate shall cease to be valid for a vehicle which is unsafe or which fails, in use, to conform to the requirements of this division.

    (6)

    The certificate and any and all renewals thereof shall be valid for a period of two years from the date thereof unless earlier suspended, revoked or terminated.

    (7)

    The board shall review all certificates within 45 days of their expirations and issue renewals when in the public necessity.

    (8)

    Any operation providing services within the county on the effective date of this division may continue to provide services without a certificate for a period of 60 days after the effective date of this division, but must apply for a certificate according to the provisions of this division within the sixty-day period.
