§ 12-222. Measurement of distance.

  • (a)

    Distance from a proposed or existing adult entertainment establishment to a preexisting adult entertainment establishment, a preexisting religious institution, a preexisting education institution, an area zoned for residential use, a preexisting park, or a preexisting commercial establishment that sells or dispenses alcohol for on-premises consumption shall be measured by drawing a straight line from the property line of the proposed or existing adult entertainment establishment which is closest to the nearest property line of the preexisting adult entertainment establishment, preexisting religious institution, preexisting educational institution, area zoned for residential use, preexisting park, or preexisting commercial establishment that sells or dispenses alcohol for on-premises consumption.

    (b)

    However, for purposes of section 12-223(a), (b) and (c), distance from such an adult entertainment establishment to a preexisting adult entertainment establishment, a preexisting religious institution, a preexisting commercial establishment that sells or dispenses alcohol for on-premises consumption, or a preexisting educational institution shall be measured by following the shortest route of ordinary pedestrian travel along a public thoroughfare from the main entrance of the proposed adult entertainment establishment to a main entrance of the preexisting adult entertainment establishment, the main door of the preexisting religious institution, or the main door of the preexisting commercial establishment that sells or dispenses alcohol for on-premises consumption, or, in the case of a preexisting educational institution, to the nearest point on the premises or site in use as a part of the education institution. Also for purposes of section 12-223(a), (b) and (c), the distance from an adult entertainment establishment to an area zoned for residential use shall be measured by following the shortest route of ordinary pedestrian travel along a public thoroughfare from the main entrance of the proposed adult entertainment establishment to the nearest property line of any property zoned for residential use.
