§ 12-205. Grant; denial.

  • (a)

    Time period. The health department shall grant or deny an application within 14 days from the date of its proper filing.

    (b)

    Grant of permit. If the sheriff and the health department have each approved of the application, the health department shall grant the application, notify the applicant of the granting, and issue a permit to the applicant.

    (c)

    Denial of permit:

    (1)

    The health department shall deny the application for any of the following reasons:

    a.

    The sheriff has disapproved of the application;

    b.

    The applicant is less than 18 years of age;

    c.

    The application contains false information;

    d.

    The applicant has had a previous permit under this code which has been suspended or revoked; or

    e.

    The granting of the application would violate a statute or ordinance or an order from a court of law which prohibits the applicant from obtaining an adult entertainment permit.

    (2)

    If the health department denies the application, it shall notify the applicant of the denial, and state the reasons for the denial.
