§ 12-181. Suspension of license.

  • (a)

    Violation of a health, building, zoning or fire statute, code, ordinance or regulation. In the event a department learns or finds upon sufficient cause that a licensed adult entertainment establishment is operating in violation of a health, building, zoning or fire statute, code, ordinance or regulation, the department shall promptly notify the licensee of the violation(s) and shall allow the licensee a seven-day period in which to correct the violation(s). If the licensee fails to correct the violation(s) before the expiration of the seven-day period, the department shall notify the tax collector, who shall forthwith suspend the license, and shall notify the licensee of the suspension. The suspension shall remain in effect until the department notifies the tax collector in writing that the violation of the provision in question has been corrected.

    (b)

    Illegal transfer. In the event the tax collector learns or finds upon sufficient cause that a licensee engaged in a license transfer contrary to section 12-179, he shall forthwith suspend the license, and notify the licensee of the suspension. The suspension shall remain in effect until the tax collector is satisfied that the requirements of section 12-179(a) have been met.

    (c)

    Violations of this code. In the event a violation of this code occurred at an establishment, the tax collector shall, upon the conviction, entry of a plea of guilty or nolo contendre for a violation of this code, suspend the license, and notify the licensee of the suspension. The suspension shall remain in effect for a period of 30 days. In the event a second violation of this code occurred within a period of two years from the date of the prior violation of this code, but not including any time during which the license was suspended, the suspension shall remain in effect for a period of 90 days. In the event a third violation of this code occurred within a period of two years from the first of the three violations, but not including any time during which the license was suspended, the suspension shall remain in effect for a period of 180 days.

    (d)

    Effective date. All periods of suspension shall begin seven days after the date the tax collector mails the notice of suspension to the licensee or on the date the licensee delivers his license to the tax collector, whichever first occurs.
