§ 12-171. Responsibilities of board, tax collector and departments.

  • Responsibility for prosecutions for violations of this article shall be in accordance with Section 125.69, Florida Statutes. The tax collector is responsible for granting, denying, revoking, renewing, suspending, and canceling adult entertainment licenses for proposed or existing adult entertainment establishments. The sheriff is responsible for verifying information contained on an application pursuant to section 12-173(b)(1) through (b)(5) and for enforcing applicable criminal statutes and ordinances, including those set forth at Division 4 of this code. In addition, the sheriff is responsible for reviewing permit applications, as provided in Division 3. The zoning and inspection department is responsible for inspecting any proposed establishment for which a license is being applied for or any licensed establishment in order to ascertain whether it complies with or is complying with Division 5 of this Code and all applicable building codes, statutes, ordinances, and regulations in effect in Okaloosa County. In addition, the zoning and inspection department is responsible for ascertaining whether a proposed establishment for which a license is being applied for complies with all locational requirements of this code, applicable portions of Division 4 and 5 of this Code, all applicable zoning regulations in effect in Okaloosa County, and whether a licensed establishment is complying with Division 5 of this Code and all applicable zoning regulations and land use laws in effect in Okaloosa County. The various fire departments are responsible for inspecting any proposed establishment for which a license is being applied for or any licensed establishment in order to ascertain whether it complies with or is complying with Division 5 of this Code and all applicable fire codes, statutes, ordinances, and regulations in effect in Okaloosa County. The health department is responsible for any proposed establishment for which a license is being applied for or any licensed establishment in order to ascertain whether it complies with or is complying with Division 5 of this Code and all applicable health codes, statutes, ordinances, and regulations in effect in Okaloosa County. In addition, the health department is responsible for reviewing permit applications, as provided in Division 3. The health department is also responsible for granting, denying, renewing, canceling, suspending, and revoking permits for proposed or current permittees in accordance with Division 3 of this Code.
