§ 12-63. Definitions.

  • For the purpose of this article, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.

    Business means and includes the operation of a pawnbroker, pawnshop or secondhand dealer as herein defined.

    Pawn means a bailment or conditional sale of personal property as security for an engagement or debt, redeemable on certain terms with the implied power of sale on default.

    Pawnbroker means any person whose business is to take or receive by way of pledge, pawn or exchange, any goods, wares or merchandise or article of personal property of any kind as security for money or other valuable consideration loaned thereon.

    Pawnshop means any business establishment which shall take or receive by way of pledge, pawn or exchange any goods, wares or merchandise or article of personal property of any kind as security for money or other valuable consideration loaned thereon.

    Person means and includes natural persons, partnerships, joint ventures, trusts or corporations, or any officers, agents, employees of any kind or personal representatives of any thereof, in any capacity, acting either for himself, or for any other person.

    Premises means an includes all lands, structures, places, and also the equipment and appurtenances connected or used therewith in any business, or as is otherwise used in connection with any such business conducted on such premises.

    Secondhand dealer means a person engaged in the business of purchasing or selling goods, wares and merchandise, or articles of any description having once been used or transferred from the manufacturer to the dealer and then received into the possession of third parties, whether the same consists of clothes, articles of personal use, jewelry of any kind or description, or old gold or silver, plumbing fixtures, secondhand building material or any other goods of the class considered personally, whether related to any of the goods above specifically described or not.
