§ 6.01.053. Acceptance.

  • Acceptance of physical improvements that are dedicated to the public is subject to the condition precedent that all physical improvements be maintained in acceptable condition for a period of at least 18 months after acceptance. The developer shall furnish to the county a minimum 24 months maintenance bond, letter of credit or other method of guarantee. The county will re-inspect the project after 12 months have elapsed and will identify to the developer unacceptable conditions. If the unacceptable conditions have not been satisfactorily corrected after the expiration of 18 months the entire bond will be called in by the county to apply to corrections for the project. Should other unacceptable conditions appear prior to the expiration of the 18-month period they will be brought to the attention of the developer for correction in a reasonable period of time. Unused sums of the bond will be returned to the developer after the county has determined that any defective conditions have been corrected. If the amount of the bond is not sufficient to cover the cost of the corrections, the developer will be billed for the additional cost and if payment is not made within 30 days after receipt of the billing the county may file a lien against any or all of the properties involved.
