§ 6. Lake Pippin Channel Maintenance Municipal Services Benefit Unit Advisory Committee.

  • The board of county commissioners of Okaloosa County, Florida, shall in accordance with Florida Statutes be the governing body of the benefit unit. The board shall exercise that function by the approval of the annual budget, receipt of the resolution determining the amount of the annual special assessment, the execution of contracts for improvements and services for the benefit unit, and disbursement of funds. The business and affairs of the benefit unit shall be administered and conducted by a committee of five (5) members of the Lake Pippin Channel Maintenance Municipal Services Benefit Unit Advisory Committee, who shall be qualified electors owning property in the benefit unit. The committee shall monitor the desires of the owners and make recommendations to the board relative to all phases of the operations of the benefit unit including but not limited to the selection of legal counsel, the selection of engineers, the proposed annual assessment to be levied and the basis therefor, the selection of contractors for the installation of improvements, the feasibility of projects, and the proposed priorities thereof.

    A.

    Selection and terms of office. The initial committee shall consist of five (5) members and two (2) alternates to be appointed to the board based on the recommendations of those persons attending an annual meeting to be called by the chairman of the committee who shall be appointed by the board upon the adoption of this ordinance. The chairman of the committee shall be Ms. Bab's Sullivan, 1021 West Choctawhatchee, Niceville, Florida. The committee shall initially be appointed for a period of one (1) year, and shall during said period adopt its own rules of procedure, by-laws, and mode of selecting and terms of committee persons for subsequent years to be ratified by approval of the board.

    B.

    Officers; meetings. The officers of the committee shall be a chairman and a secretary. The secretary shall be elected by the committee at their first meeting and shall have the duties usually pertaining to that office. A record shall be kept of all meetings of the committee and in such meetings concurrence of a majority of the members shall be necessary to any affirmative action by the committee. The meetings of the committee and minutes of the meetings shall be open to the public at all times.

    C.

    Annual special assessment; budget. The committee shall meet prior to July 15th of each year to prepare its annual budget and determine the annual special assessment for the parcels of property within the benefit unit based on the expenses and proposed projects for the subsequent fiscal year, said budget and annual special assessment to be reduced to resolution form and submitted in accordance with section 7.B. of this ordinance.
